People ask me all the time if they need to consult an attorney while writing their patent. My answer is ALWAYS.

Intellectual property law is one of the least understood areas of practice. Consult an attorney who specializes exclusively in Intellectual Property law.

Pay your attorney for advice only. Most of the grunt work you can do yourself, with advance research and writing. Once you have a draft ready, take it to your attorney and let him take it from there.

Where do I Start Writing My Own Patent?

You can go to many resources on the web and actually download templates for writing your own patent for as little as $50, much like the template you downloaded for writing your own business plan. It is always best to start with the free tools available at USPTO.gov

Patent Agent? or Patent Attorney?

I can't tell you how many people I've consulted with who choose a Patent Agent over a Patent Attorney, thinking it would save them money. It never has.

Patent Agents are the people you find on legal websites, where you purchase services anonymously. Just say no! They almost always charge the same amount as a good patent attorney, with half the experience. Plus, they're not local, and most people have a hard time getting them to follow-up, as their experience has proven to me.
